By purchasing or accessing any Course, you agree to the terms in this Agreement. If you do not agree, please do not purchase or access any Course.

1. OVERVIEW OF COURSES

We offer online courses that teach the art of creating glitter photos through pre-recorded video lessons by Dyana Klein, glitter artist and instructor (“Instructor”). Courses are hosted on the Thinkific platform at https://crystalprints.thinkific.com/ (the “Platform”).

We may update/change Course offerings, pricing, or benefits at any time. Any changes will not affect Participants who already purchased a Course before the change takes effect.

2. PURCHASE AND ENROLLMENT PROCESS

After your payment is confirmed, you will receive an email with a link to create an account on the Platform and access your Course. Please make sure you provide a valid email address and check your spam or junk folders for the confirmation email. We are not responsible for delays caused by incorrect contact information.

Payment is processed at the time of purchase using the payment methods available on crystalprintshop.thinkific.com. All prices are listed in U.S. dollars, though currency conversion is available so you can pay in your own currency. You are responsible for any applicable taxes or other charges from your bank or payment provider. We do not store your credit card or payment details directly — payments are handled by third-party processors and are subject to their own terms.

3. ACCESS PERIOD

You will have access to your Course for 180 days (approximately six months), starting on the date of your purchase (the “Access Period”). After your Access Period ends, your access will be deactivated. We are not required to extend or renew your access, though we may offer renewal options at our discretion.

4. REFUND POLICY

No refunds will be issued once you have accessed the Course on the Platform. Once you log in and access any part of the Course content, the digital product is considered delivered. By purchasing a Course, you agree that accessing it counts as delivery and that no refund will be available after that point.

If you have purchased a Course but have not yet accessed the Platform (meaning you have not created an account or logged in), you may request a refund by contacting us at the email listed on crystalprintshop.com within 14 days of your purchase date. Refund requests will be reviewed case by case, and if approved, the refund will be returned to your original payment method within 10 business days. No refunds will be granted after the 14-day window, whether or not the Course has been accessed.

5. INTERNATIONAL PARTICIPANTS — PHYSICAL PRODUCT AVAILABILITY DISCLAIMER

Effective June 1 or shortly thereafter CrystalPrints will expand shipping of  the Artistry Trio Glitter Kits and Bulk Glitters — Globally. Physical products may not be available to ship to your country at time of course purchase. If you are located outside these delivery zones, you will not be able to order physical products from us.

If you are within our delivery zones, you may separately purchase physical products through our website under the applicable terms. Please be aware that international orders for physical products may be subject to customs duties, import tariffs, or other fees imposed by your country, which are beyond our control and are your responsibility. The existence of such fees does not entitle you to a discount on, or refund of, any Course you have already accessed. Purchasing a Course does not include any physical products, materials, or kits unless specifically stated in the Course description at the time of purchase.

6. COURSE CONTENT DISCLAIMER AND LIMITATION OF RESULTS

The Course content is based on techniques and knowledge developed using CrystalPrints-specific materials and tools. We cannot guarantee specific results for any Participant, whether using CrystalPrints products or other materials. While the techniques taught may be applicable to other clear glitters or similar materials, we do not have experience with, and are not responsible for, how third-party materials and tools perform for glitter art.

The Course is for educational purposes only. We do not guarantee any specific results or skill level from completing the Course. Your results will depend on your own skill, effort, materials, and other factors we cannot control. We disclaim all warranties, express or implied, including any warranties of merchantability or fitness for a particular purpose, as they relate to the Course content.

7. INTELLECTUAL PROPERTY

All Course content — including video lessons, images, graphics, text, audio, and downloadable materials (together, “Course Materials”) — are owned by CrystalPrints LLC and/or its licensors and is protected by copyright and other intellectual property laws. You are granted a limited, personal, non-transferable license to access and view the Course Materials for your own non-commercial educational use during your Access Period.

You may not: (a) copy, reproduce, distribute, or create derivative works from any Course Materials; (b) record, download (except where we expressly allow it), or screen-capture any video or audio from the Course; (c) share your login credentials or Course access with anyone else; (d) use any Course Materials for commercial purposes — including teaching, reselling, or incorporating them into your own products or services — without our prior written consent; or (e) remove or alter any copyright or trademark notices from the Course Materials.

Unauthorized use of Course Materials may result in immediate termination of your access without a refund and may lead to legal action.

8. PARTICIPANT CONDUCT

You agree to use the Course and Platform in a lawful and respectful manner. If your Course includes community features (forums, office hours, etc.), you may not: (a) post content that is defamatory, obscene, threatening, harassing, or discriminatory; (b) disrupt the learning experience for others; (c) advertise or promote competing products or services; or (d) engage in any activity that violates applicable laws.

We may remove any content you post and may suspend or terminate your access to the Course and community features, without a refund, if we reasonably believe you have violated this section or any other part of this Agreement.

9. PRIVACY AND DATA COLLECTION

We collect personal information when you purchase and enroll in a Course, such as your name, email address, and payment details. How we collect and use your information is described in our Privacy Policy, available on crystalprintshop.com, which is part of this Agreement. By enrolling in a Course, you consent to our use of your information as described in the Privacy Policy.

Because the Course is hosted on Thinkific, your use of the Platform is also subject to Thinkific’s own terms of service and privacy policy, available at www.thinkific.com. We encourage you to review those. We are not responsible for Thinkific’s data practices.

10. LIMITATION OF LIABILITY

To the fullest extent allowed by law, we (including our owners, officers, employees, agents, affiliates, and the Instructor) will not be liable for any indirect, incidental, special, consequential, or punitive damages — such as lost profits, lost data, or loss of goodwill — arising from your purchase, access, or use of (or inability to use) the Course, Platform, or Course Materials, regardless of the legal theory and even if we have been warned about the possibility of such damages.

Our total liability to you for any claims related to this Agreement or the Course is limited to the amount you paid for the Course in question. This limit applies to the fullest extent allowed by law and survives the end of this Agreement.

Nothing in this Agreement limits liability for: (a) death or personal injury caused by negligence; (b) fraud; or (c) anything else that cannot be limited by law.

11. INDEMNIFICATION

You agree to defend and hold harmless the Company, its owners, officers, employees, agents, affiliates, and the Instructor from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Course or Course Materials; (b) your breach of this Agreement; (c) your violation of any law; or (d) your use of any materials or tools in connection with glitter art, whether or not those materials were discussed in the Course.

12. TERMINATION

We may suspend or terminate your access to the Course if you violate this Agreement, engage in fraudulent or abusive conduct, or for any other reason we reasonably determine warrants it. If we terminate your access for cause, no refund will be provided.

You may stop using the Course at any time, but doing so does not entitle you to a refund or extend your Access Period. Once your access ends (whether by expiration or termination), your license to use the Course Materials is revoked, and you must stop using any Course Materials you may have.

Sections 6, 7, 10, 11, 13, 14, and 15 of this Agreement shall survive any expiration or termination of this Agreement.

13. DISPUTE RESOLUTION

If a dispute arises out of this Agreement or the Course, the parties agree to first try to resolve it informally by contacting us at the email address listed on crystalprintshop.com. Both sides should make a good-faith effort to resolve any dispute within 30 days.

If the dispute is not resolved informally within 30 days, either party may start binding arbitration through the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will be handled by a single arbitrator in Monterey County, California. The arbitrator’s decision will be final and can be entered as a judgment in any court.

Each party pays its own costs for the arbitration, except that filing fees will follow the AAA’s consumer fee schedule. You agree that any arbitration will be on an individual basis — not as part of a class action or group proceeding.

Either party may still go to court to seek emergency relief (such as an injunction) to protect intellectual property rights.

14. GOVERNING LAW

This Agreement is governed by the laws of the State of California. For any legal proceedings not covered by the arbitration clause in Section 13, both parties agree to the exclusive jurisdiction of the state and federal courts in Monterey County, California.

15. GENERAL PROVISIONS

Entire Agreement. This Agreement, along with our Privacy Policy and any terms shown on crystalprintshop.thinkific.com at the time of purchase, is the complete agreement between us and replaces any prior discussions or agreements on this subject.

Changes to This Agreement. We may update this Agreement at any time by posting new terms on crystalprintshop.com or the Platform. We will notify you of material changes by email. If you continue using the Course after changes are posted, you are agreeing to the updated terms. Changes will not retroactively reduce the rights of Participants who purchased before the update.

Severability. If any part of this Agreement is found to be unenforceable, the rest of the Agreement will remain in effect, and the unenforceable part will be adjusted as needed to make it valid while keeping the original intent.

Waiver. If either party does not enforce a right under this Agreement, that does not mean they give up that right. Any waiver must be in writing and signed by the waiving party to be effective.

Assignment. You may not transfer or assign this Agreement without our written consent. We may assign this Agreement in connection with a merger, acquisition, or sale of our business.

Force Majeure. Neither party is liable for delays or failures caused by events beyond their reasonable control, such as natural disasters, government actions, internet outages, power failures, or platform disruptions.

BY PURCHASING A COURSE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS AGREEMENT.
